New legislation is currently before Parliament as part of the Government’s wider BEPS tax reform package. These rules are intended to ensure that New Zealand subsidiaries of multinational companies return a fair share of group profit in New Zealand and do no “shift” profits out of New Zealand through transfer pricing and financing measures

Included in these reforms are some particular rules to limit the allowable interest rate on loans to New Zealand related companies, revised transfer pricing rules and the ability of Inland Revenue to recharacterise transactions in certain circumstances. Other reforms, as part of this package, include changes to thin capitalisation, permanent establishment and anti-hybrid rules.
